Bastion Pest Pros Terms of Use

These Terms of Use (“Terms”) govern your use of the Bastion Pest Pros website at bastionpestpros.com, our phone line, and any related services (together, the “Service”). The Service is operated by Bastion Pest Pros (“Bastion,” “we,” “us,” “our”).

Please read these Terms carefully. They include a limitation of liability and other provisions that affect your legal rights.

1. Acceptance of These Terms

By using the Service, including visiting our website or calling our phone line, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you agree to these Terms on that business’s behalf.

2. Description of the Service

Bastion is a free referral service that connects people seeking pest control with independent, licensed local pest control providers (“Providers”).

  • We are not a pest control company.
  • We do not perform inspections, treatments, fumigation, exclusion, wildlife removal or any other pest control work.
  • We do not hold pest control licenses.
  • We do not employ, supervise or control Providers.

The Service may include connecting or transferring your call to a Provider, sharing your request details with a Provider, and publishing general informational content about pests. Bastion may receive compensation from Providers. Using the Service is free for you.

3. No Guarantee of Availability or Provider Work

Service availability varies by area. We do not guarantee that:

  • A Provider will be available in your area, for your pest, or at a particular time
  • A Provider will contact you, accept your job, or complete it on any schedule
  • A Provider’s price will fall within any range shown on our website
  • Any treatment will be effective or will prevent pests from returning

We do not endorse, recommend, warrant or guarantee any Provider or the quality, safety, legality or results of any Provider’s work. References to “licensed” Providers mean Providers that represent to us that they hold the required licenses; you are responsible for verifying a Provider’s license and insurance before hiring them.

4. Third-Party Providers

Providers are independent third parties. Any agreement for pest control services is solely between you and the Provider.

The Provider is solely responsible for its licensing, permits, insurance, pricing, quotes, contracts, billing, scheduling, work, products, guarantees, warranties and re-treatment terms. Bastion is not a party to your agreement with the Provider and is not responsible for any Provider’s acts or omissions.

If you have a question, complaint or dispute about a Provider’s work, you agree to contact the Provider directly. We may, but are not obligated to, help you contact a Provider.

5. Your Responsibilities

When you use the Service, you agree to:

  • Give accurate information about yourself, your property and your request
  • Use the Service only for lawful purposes and for your own genuine pest control needs
  • Have the right to authorize work at the property, or get the owner’s or landlord’s permission
  • Verify a Provider’s license, insurance and terms before hiring them
  • Follow the Provider’s safety, preparation and aftercare instructions
  • Call 911 for any medical emergency; the Service is not an emergency service

You agree not to:

  • Submit false, fraudulent or misleading requests or impersonate anyone
  • Harass, threaten or abuse our staff or any Provider
  • Copy, scrape or reuse our content except as allowed by law or these Terms
  • Interfere with the security or operation of the Service, or try to access it without authorization
  • Use the Service to send spam or unsolicited marketing

6. Calls, Recordings and Messages

Calls may be recorded for quality and training. If a call is recorded, you’ll hear a notice at the start of the call. See our Privacy Policy for how recordings are handled.

By giving us your phone number, you agree that we and the Provider you are connected with may contact you by phone or text about your request. Message and data rates may apply. You can reply STOP to opt out of texts.

7. Content Disclaimer

Content on the Service, including guides, cost ranges, checklists and tables, is for general information only. It is not professional pest control, legal, medical or safety advice for your situation.

Cost figures are typical ranges from published sources and are not quotes. Laws on pesticides, wildlife and protected species vary by state. We try to keep content accurate, but we do not warrant that it is complete, current or error-free. See our Disclaimer.

8. Intellectual Property

The Service, including its text, graphics, logos, design and the Bastion Pest Pros name, is owned by Bastion Pest Pros or its licensors and is protected by intellectual property laws. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, BASTION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BASTION AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR PROPERTY, ARISING OUT OF OR RELATED TO THE SERVICE OR ANY PROVIDER’S ACTS, OMISSIONS, PRODUCTS OR WORK.

TO THE FULLEST EXTENT PERMITTED BY LAW, BASTION’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU.

11. Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold harmless Bastion and its owners, officers, employees and agents from any claims, damages, losses and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Service, your violation of these Terms, or your dealings with any Provider.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the Service will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction, unless applicable law requires otherwise.

13. Changes to the Service or These Terms

We may change, suspend or stop any part of the Service at any time. We may update these Terms from time to time and will change the effective date when we do. Your continued use of the Service after an update means you accept the updated Terms.

14. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and Bastion about the Service. You may not assign these Terms; we may assign them in connection with a business transfer.
